These Terms of Use ("Terms") govern your access to and use of Vital's mobile application and related services ("Service"), operated by Vital Routines Inc. ("Vital", "we", "us", or "our"). Please read these Terms carefully before using the Service.

Acceptance of Terms

By accessing or using the Service, you agree to be bound by these Terms. If you disagree with any part of the Terms, you may not access the Service.

Subscription Terms

The Service requires an active subscription:

  • 7-day free trial for new users
  • Monthly subscription: $4.99/month
  • Annual subscription: $39.99/year

Subscription Terms:

  • Payment will be charged to your Apple ID account at confirmation of purchase
  • Subscription automatically renews unless auto-renew is turned off at least 24 hours before the end of the current period
  • Account will be charged for renewal within 24 hours prior to the end of the current period
  • You can manage and cancel your subscription through your App Store settings
  • Any unused portion of a free trial period will be forfeited when purchasing a subscription

Health Data Usage

By using the Service, you acknowledge and agree that:

  • The Service processes health data from Apple Health and other connected services
  • Health data is processed locally on your device when possible
  • The Service is not a substitute for professional medical advice, diagnosis, or treatment
  • You should consult healthcare professionals for medical advice

User Accounts

When creating an account, you agree to:

  • Provide accurate and complete information
  • Maintain the security of your account credentials
  • Promptly notify us of any unauthorized use of your account
  • Accept responsibility for all activities that occur under your account

Prohibited Uses

You agree not to:

  • Use the Service for any unlawful purpose
  • Attempt to gain unauthorized access to the Service
  • Interfere with or disrupt the Service or servers
  • Reverse engineer, decompile, or modify the Service
  • Share your account credentials with others

The Service and its original content, features, and functionality are owned by Vital and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND. WE DO NOT GUARANTEE THE ACCURACY, COMPLETENESS, OR USEFULNESS OF THE SERVICE.

The Service is not intended to provide medical advice. Always consult qualified healthcare professionals for medical advice, diagnosis, or treatment.

Limitation of Liability

IN NO EVENT SHALL VITAL BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATING TO YOUR USE OF THE SERVICE.

Indemnification

You agree to indemnify and hold Vital harmless from any claims, losses, damages, liabilities, and expenses arising out of your use of the Service or violation of these Terms.

Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice, for any breach of these Terms. Upon termination, your right to use the Service will immediately cease.

Modifications to Terms

We reserve the right to modify or replace these Terms at any time. We will notify you of any material changes before they become effective. Continued use of the Service after any changes constitutes acceptance of the new Terms.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions.
